These Terms of Service explain the rules for using WakeUp, including alarm functionality, missions, wake checks, subscriptions, limitations of iOS alarms, and acceptable use of the app.

These Terms of Service (“Terms”) govern your use of WakeUp (“the App”), a mobile iOS application developed and operated by Dzianis Huletski (“Developer”, “we”, “us”, or “our”). By downloading, installing, or using the App, you agree to these Terms.
1. What WakeUp Is
WakeUp is an alarm app designed to help users wake up more reliably by combining alarms with short cognitive or physical missions and optional wake-check follow-ups. The App may include alarm scheduling, mission chains, wake verification, statistics, and premium features.
WakeUp is intended as a productivity and habit-support tool. It is not a medical, emergency, or life-critical alerting service.
2. Not a Guaranteed Wake-Up Service
WakeUp is designed to improve wake-up reliability, but it cannot guarantee that you will wake up, stay awake, or never miss an alarm.
This is especially important because iOS imposes technical limitations outside our control, including but not limited to:
- the system notification limit;
- force-closing the app by the user;
- silent mode, Focus modes, or Do Not Disturb behavior;
- device audio volume and hardware settings;
- battery state, system restrictions, and background execution limits;
- camera or motion permissions being disabled;
- device restarts, software updates, or operating system behavior.
You remain solely responsible for using any backup alarm methods you consider necessary for school, work, travel, medication, caregiving, or any other important obligation.
3. No Emergency or Safety-Critical Use
The App must not be relied upon as the sole alarm or notification system for:
- medical or health-related needs;
- emergency wake-ups;
- timing for medication or treatment;
- aviation, driving, industrial, or hazardous work;
- childcare, eldercare, or other safety-dependent situations;
- any scenario where a missed alert could cause injury, damage, or loss.
4. User Responsibilities
To use the App effectively, you are responsible for:
- keeping your device charged and functioning;
- setting device volume appropriately;
- reviewing permission settings such as notifications, motion access, and camera access;
- not force-closing the app if you expect full background alarm-related behavior;
- verifying your alarm settings, mission configuration, and repeat rules;
- using additional backup alarms where appropriate.
5. Missions and Wake Checks
The App may require you to complete missions such as math challenges, movement tasks, QR or barcode scans, or similar wake-up tasks before an alarm is dismissed. It may also trigger a wake-check a few minutes later to confirm that you remain awake.
These features are intended to increase engagement and reduce passive snoozing. They do not guarantee successful waking, and their effectiveness depends on user behavior, permissions, device conditions, and system limitations.
6. Feature Availability
Some features may be limited by device model, iOS version, permissions, or your subscription tier. For example, certain mission types may require camera access or motion access, and some premium features may only be available to paid subscribers.
We may add, change, remove, suspend, or redesign features at any time.
7. Subscription and Premium Access
WakeUp may offer free and paid subscription-based access. Premium access may unlock additional alarms, mission chains, wake checks, advanced statistics, premium mission types, or similar features.
Purchases, billing, renewals, and cancellations are handled through Apple’s App Store and your Apple ID account. Additional subscription details may be described on the Subscription Terms page.
8. Acceptable Use
You agree not to:
- use the App in violation of applicable laws or regulations;
- attempt to interfere with, disable, or reverse engineer the App beyond rights allowed by law;
- use the App in a way that could damage, overload, or disrupt its normal operation;
- misrepresent the App as providing emergency, medical, or guaranteed wake-up services;
- use the App in any abusive, fraudulent, or unauthorized manner.
9. Intellectual Property
WakeUp, including its design, code, content, structure, branding, and visual assets, is owned by the Developer except where third-party rights apply. These Terms do not transfer ownership of the App or its intellectual property to you.
You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful use on supported Apple devices, subject to these Terms and App Store rules.
10. App Store Terms
Your use of the App is also subject to Apple’s App Store rules, policies, and standard license terms where applicable. If there is a conflict between these Terms and mandatory App Store rules, the mandatory App Store rules will govern to the extent of that conflict.
11. Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, to the maximum extent permitted by applicable law.
We do not warrant that:
- the App will always function without interruption or error;
- all alarms will always trigger as expected under every device condition;
- missions, wake checks, or wake-up statistics will always be accurate or effective;
- the App will be suitable for every user, schedule, or device setup.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, including missed alarms, missed appointments, missed transportation, lost income, personal inconvenience, or similar losses arising from use of or inability to use the App.
If applicable law does not allow certain exclusions, some of these limitations may not apply to you.
13. Changes to the App
We may update, modify, suspend, or discontinue parts of the App at any time, including premium functionality, mission types, wake-check behavior, interface flows, or subscription offerings.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may revise the effective date above and publish the updated version on the App’s legal page.
15. Termination
We may suspend or terminate access to the App or certain features if required by law, platform policy, technical necessity, or misuse of the App. You may stop using the App at any time by deleting it from your device.
16. Governing Law
These Terms are governed by the laws of Poland, unless otherwise required by applicable consumer protection law in your country of residence.
