These Terms of Service (“Terms”) govern your access to and use of 5 Seconds (“the App”), a mobile game developed and operated by Dzianis Huletski (“Developer”, “we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What 5 Seconds Is

5 Seconds is a mobile party game designed for local entertainment and casual gameplay. Depending on the version of the App, it may include question rounds, category packs, game modes, unlockable content, premium features, subscriptions, and future updates or expansions.

2. Eligibility

You may use the App only in compliance with applicable laws and platform rules. If you are under the age required to enter into a binding agreement in your jurisdiction, you may use the App only with the involvement or permission of a parent or legal guardian where required.

3. License to Use the App

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial entertainment purposes on devices you own or control, in accordance with Apple’s platform rules.

This license does not transfer any ownership rights to you.

4. Purchases and Premium Access

The App may offer paid content, premium access, or subscriptions through Apple’s in-app purchase system. Any billing, payment handling, renewals, cancellations, and refund policies are administered by Apple under your App Store account terms.

We do not control Apple’s payment processing, and we do not guarantee refunds except where required by law or Apple’s policies.

5. Acceptable Use

You agree not to:

• use the App in a way that violates any applicable law or regulation;
• copy, modify, distribute, sell, lease, sublicense, or commercially exploit the App except as allowed by law;
• reverse engineer, decompile, disassemble, or attempt to extract source code except where such restriction is prohibited by law;
• interfere with the operation, security, or stability of the App;
• use the App to create abusive, unlawful, or harmful user-generated content if such features are introduced;
• misrepresent the App, the Developer, or your relationship to the product.

6. User Content and Custom Features

If the App includes custom prompts, custom packs, saved game content, or similar features now or in the future, you remain responsible for the content you create, import, or share through those features.

You agree not to use such features to create or distribute unlawful, infringing, abusive, hateful, threatening, or otherwise harmful content.

7. Intellectual Property

The App, including its code, design, game mechanics, visual identity, text, branding, graphics, sounds, question structure, original packs, and related materials, is owned by or licensed to the Developer and is protected by applicable intellectual property laws.

You may not copy or reuse protected content except as expressly allowed by these Terms or applicable law.

8. Updates and Changes

We may update, improve, modify, suspend, or discontinue all or part of the App at any time. We may also add, remove, or change features, content packs, pricing, gameplay structures, or technical requirements.

We are not obligated to continue supporting any specific feature indefinitely.

9. Availability

We aim to provide a stable and enjoyable experience, but we do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device, operating system version, or region.

10. Entertainment Purposes Only

5 Seconds is provided for entertainment purposes only. Any content, prompts, pack themes, or gameplay material are intended as part of a recreational game experience and should not be interpreted as professional advice, factual guarantees, or suitability for every player or audience.

11. Safety and Audience Considerations

Some game packs, prompts, or themes may not be suitable for every age group, context, or social setting. You are responsible for choosing how, where, and with whom to use the App. Where relevant, please review the Safety & Content Notes page for additional guidance.

12. Privacy

Your use of the App is also subject to our Privacy Policy, which explains how information may be processed in connection with the App.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We disclaim, to the fullest extent permitted by law, any warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of goodwill, loss of profits, or business interruption arising out of or related to your use of or inability to use the App.

Where liability cannot be excluded, it will be limited to the minimum amount required by applicable law.

15. Termination

We may suspend or terminate your access to the App or specific features if you violate these Terms, misuse the App, or if continued operation becomes impractical, unlawful, or technically impossible.

You may stop using the App at any time by deleting it from your device and discontinuing use.

16. Governing Law

These Terms are governed by the laws applicable in Poland, unless otherwise required by mandatory consumer protection law in your country of residence.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may revise the effective date above and publish the updated version on the App’s legal page.
